Any person interviewed shall have the right to review his or her statement for accuracy. Within thirty 30 business days of receiving the formal written complaint, the investigator will assess whether a violation of the Standards of Conduct has occurred and will submit findings in writing to the complainant and the accused person. If the investigator finds by a preponderance of the evidence that the alleged violation has occurred, the investigator shall notify the Affirmative Action Office if the Affirmative Action Office is not the investigator, the accused person, his/her supervisor, the appropriate Associate Dean, and the Dean and Provost of the School of Medicine of the findings. The supervisor of the accused person shall be responsible for acting on the findings of the investigator and shall consult with the appropriate School of Medicine administrative officials including the Dean and Provost of the School of Medicine, the appropriate Associate Dean, and the Affirmative Action Office regarding formal disciplinary actions to be taken against the accused person. Decisions regarding appropriate disciplinary action shall be made in accordance with applicable University and School of Medicine policies and procedures with consideration of properly established records of previous conduct and the seriousness of the violation. The supervisor may also review any part of the investigative records to assist in the decision making process. Within ten 10 business days of receiving the investigators findings, the supervisor shall meet with the accused person to discuss the findings and recommendations and shall determine appropriate disciplinary action. Appropriate discipline may range from an oral reprimand up to and including termination/dismissal for cause or any other appropriate remedial action. The accused person, the investigator, and the Affirmative Action Office if not the investigator will be notified in writing of the action taken by the supervisor. The Affirmative Action Office will in turn, notify the complainant regarding the resolution of the complaint, what corrective action, if any, will be taken, and/or, in general, whether any discipline will be imposed. The complainant may file an appeal of any decision concerning the resolution of the formal complaint.
